Attorney Matthew Aguirre Racks Up Key Wins for The Ryan Firm Clients

Matthew Aguirre joined The Ryan Firm in 2023, and is a familiar face!  Mr. Aguirre initially worked at The Ryan Firm back in 2012, until family commitments called him back to San Diego, where he worked for noted creditors’ rights and secured lending law firm Kirby McGuinn.  After the cessation of Kirby McGuinn, The Ryan Firm successfully lured Mr. Aguirre, with his notable litigation acumen, back to the firm.


Since rejoining the firm, Mr. Aguirre has brought his law and motion skills and deep knowledge of title and loan servicing litigation to bear on behalf of The Ryan Firm’s clients.  Listing Mr. Aguirre’s impressive wins for The Ryan Firm clients would consume pages, but even a sampling of Mr. Aguirre’s recent key cases showcases his skills and tenacity in yielding impressive results for our valued clients.


  • A seventeen-year real estate professional and former borrower, aided by a very aggressive foreclosure challenge attorney, sued our client twice (alleging fifteen causes of action) for various loan servicing violations, challenging the loan, loan servicing, and every aspect of a coming foreclosure in a very difficult venue.  Incredibly, Matt obtained dismissal of each case in roughly six months, allowing the client to not only foreclose, but also to recover its litigation costs.  Then, Matt worked with firm shareholder Rosty Gore to convince our eviction trial judge to overlook a frivolous bankruptcy filing on the very morning of trial.  Together, Matt and Rosty tried the case and obtained judgment that same morning, to the astonishment of the defendant borrower.  Tenacious.


  • Our client’s loan was secured by a Beverly Hills office building in one of the largest and most complex bankruptcies and receiverships in recent memory.  Matt expertly navigated to a foreclosure of the loan – but a “friendly lease” to a related entity appeared to stick our client with an undesirable tenant.  Matt, working with attorneys Timothy Ryan and Andrew Mase, found an incurable breach of this “friendly lease,” and promptly and successfully moved to evict based on this breach.  Now, the client is addressing years of deferred maintenance and creating an incredible commercial space in a very desirable location.  Creative. 


  • In another eviction matter, Matt was able to change the court’s mind and reverse the judge’s tentative ruling after providing comprehensive and persuasive briefing about the proper application of Civil Code 2924m – to obtain an eviction judgment.  Thereafter, Matt settled both the appeal and the foreclosure challenge litigation – allowing the client to liquidate the asset.  Knowledgeable.


Matt brings a depth of understanding of the foreclosure process (even as it continues to evolve), a tenacious attitude, and significant bankruptcy and receivership experience to our firm.  As you work with him, you will undoubtedly recognize his unwavering resolve and remarkable fortitude.
