Client Update: LA County Doubles Rent Debt Threshold Before Eviction Can Begin

Dear Valued Clients,


Effective April 16, 2026, landlords in unincorporated areas of Los Angeles County can no longer file an unlawful detainer for nonpayment of rent until a tenant owes two full months of HUD Fair Market Rent (previously one month). This change applies to all units located in Unincorporated Los Angeles County that are under the County’s just cause eviction rules—including single-family homes.  This new protection gives tenants additional breathing room but ironically will make it more difficult for the tenant to cure once eviction begins.  Bona fide breaches, other than non-payment of rent, may now provide a more expeditious route to a completed eviction.


We recommend reviewing your rental agreements, implementing stricter late-rent policies, monitoring property condition for other breaches, and documenting all communications.
